Messy Play Terms and Conditions

This contract (“Contract”) is between Explore and Learn and you (the “Client”) as specified in the Application Form. By signing this Contract, you agree to the following terms and conditions (“Conditions”) in order to receive the services detailed in the Application Form. References to “we” or “us” shall mean Explore and Learn.

1. HEALTH AND SAFETY OBLIGATIONS

1.1. You, as the parent or carer, accept full responsibility for the safety and supervision of your child/children while attending an Explore and Learn session. Children must not be left unattended at any time. All materials are intended to be used under constant supervision.

1.2. All products used are non-toxic or taste-safe but are not intended to be eaten.

1.3. We do not use products containing nuts, soy, dairy, or eggs in our activities. However, some products may carry allergy warnings indicating they may contain traces of these allergens.

1.4. It is your responsibility to inform us of any allergies at the time of booking or contact us to ensure the session is safe for your child. Parents and guardians must assess the risk and suitability of each activity based on their child’s abilities. Explore and Learn assumes no responsibility for allergic reactions resulting from participation in our services.

1.5. We request that any food brought to an Explore and Learn session be nut-free. Please refrain from consuming food or beverages in the activity areas. While we do not enforce these guidelines, your cooperation helps maintain a safe environment for everyone.

1.6. Parents or guardians must ensure that children wear nappies or underwear at all times. Inform a staff member if your child has a toilet accident so the affected area can be cleaned and sanitised.

1.7. Participants engage in messy activities, which may include substances like slime. While we prioritise safety, some risk is inherent. By booking a service, you acknowledge and accept this risk. Explore and Learn is not liable for injuries or damages except in cases of gross negligence or wilful misconduct. Some stations may have wet materials, making the floor slippery. Please walk carefully between stations.

2. MESSY PLAY BOOKINGS

2.1. To prevent overcrowding, each ticket admits one child and one parent/carer. Additional tickets are required for extra adults.

2.2. Explore and Learn is not responsible for missed sessions (including due to illness). No refunds or credits are available in such cases.

2.3. Check in with a staff member upon arrival and show your ticket confirmation. Screenshots are not accepted.

2.4. If a facilitator deems a child unwell, Explore and Learn reserves the right to deny entry for health and safety reasons. No refunds or credits are issued in such cases.

2.5. Full payment is required at booking, inclusive of fees.

2.6. Tickets are non-refundable and non-changeable for missed sessions or events. You may transfer your ticket to another person by emailing info@exploreandlearn.com.au with the new name. Term Enrolments may arrange a make-up session, subject to availability.

3. REFUNDS

3.1. Deposits are non-refundable, regardless of cancellation timing.

3.2. If Explore and Learn cancels a booking, a full refund of all fees paid will be provided.

3.3. No cancellations or refunds are allowed during a 10-week term once enrolled.

3.4. Refund requests may be approved at Explore and Learn's discretion, with fees refunded less the deposit and any transaction fees.

Messy Play Term Dates for 2024

Students are required to attend the full term independent of the school system they attend.
Term 1: Tues 30th Jan – Tues 9th April
Term 2: Tues 30th April – Tues 2nd July
Term 3: Tues 23rd July – Tues 24th Sept
Term 4: Tues 15th Oct – Tues 17th Dec

4. COMMUNICATION

4.1. Parents/caregivers consent to receive communications related to updates, events, and promotions to the contact details provided upon enrolment.

4.2. All regulations, policies, and procedures outlined in this document must be observed.

5. PHOTOS & PUBLISHING

5.1. Photos and videos may be taken during sessions for use on our website, social media, and promotional materials.

5.2. If you do not wish for photos to be taken, indicate this on your booking form and inform the event leader at check-in. We will always seek verbal permission before taking photos.

6. DISCLAIMER

6.1. Explore and Learn is not responsible for cleaning carpet stains. Hosting parties in easily cleaned areas is recommended. Cleaning is limited to the activity area only.

6.2. Messy play may result in stained or dirty clothes. Explore and Learn is not responsible for damaged or lost belongings.

6.3. Activities are designed to be age-appropriate and safe. Parents should assess suitability for their child.

6.4. Testimonials represent past customer experiences; individual results may vary.

6.5. Explore and Learn is not responsible for personal possessions lost or damaged during sessions.

7. INDEMNITY

7.1. Parents/caregivers agree to indemnify and defend Explore and Learn against claims, liabilities, losses, or expenses arising from participation in Explore and Learn activities.

8. CONFLICT OF INTEREST

8.1. Attendees of Explore and Learn sessions are prohibited from establishing similar messy play groups within a 30km radius without written permission from a Director of Explore and Learn Ltd. All activities and materials are the intellectual property of Explore and Learn Ltd.

MESSY PLAY PRIVATE BOOKINGS

1.5. Some stations may have wet materials, making the floor slippery. Please walk carefully between stations.

2. PAYMENT & CANCELLATIONS

2.1. A $100 non-refundable deposit is required to secure your booking. The balance is due via bank transfer at least 14 days before the event.

2.2. The booking price includes all fees and charges.

2.3. Final payment is non-refundable and non-changeable for cancellations within 7 days of the booking.

2.4. Explore and Learn reserves the right to cancel bookings due to unforeseen circumstances. In such cases, a refund or credit/gift voucher will be provided.

3. OFF SITE PARTY CONSIDERATIONS

3.1. Access to the venue is required for at least 3 hours (dependant on package): 1 hour for setup, 1 hour for play, and 1 hour for clean up. Clean up covers the messy play area only.

3.2. Outdoor venues must provide shade to prevent the trays from overheating.

4. PHOTO CONSENT

4.1. Photos and videos may be taken for promotional use. Indicate on your booking form if you do not wish for photos to be taken. Permission will always be sought before taking photos during sessions.

4.2. No photos are taken during Early Learning Centre or School Incursions.

5. SOFT PLAY

5.1. Inspect the service items upon delivery and notify staff of any issues.

5.2. Explore and Learn is not liable for personal injury or damages from item hire.

5.3. You are responsible for determining age and skill suitability and supervising use.

5.4. You are liable for the replacement cost of stolen, destroyed, or damaged items.

5.5. Do not bring food, drinks, or shoes onto the soft play equipment. Failure to comply may result in bond claims.
