Messy Play Terms and Conditions

The following are the Conditions of your Explore and Learn Contract. This contract is between Explore and Learn and you as detailed in the Application Form (the “Client”). In order to receive the services detailed in the Application Form you agree to abide by the following Conditions. When this contract references “we” or “us” it shall be read as reference to Explore and Learn.

1. HEALTH AND SAFETY OBLIGATIONS

1.1. Parent/Carer's must accept FULL RESPONSIBILITY for the safety and supervision of your child/children whilst attending the Explore and Learn session. Please DO NOT leave your child unattended at any time. All materials are prepared in the knowledge that they will be played with under constant parent/carer supervision.

1.2. All products used are non-toxic or taste safe however they are NOT intended to be eaten.

1.3. We DO NOT use any products containing; nuts, soy, dairy or eggs in our messy play activities. However some products used do have allergy labels warning the product "May Contain traces of" these allergens.

1.4. It is your responsibility to advise us of any allergies at the time of booking or Contact Us to ensure our session is safe for your child. Parents and guardians are responsible for assessing the risk and suitability of each activity based on their child's individual abilities. You acknowledge and agree that Explore and Learn assumes no responsibility for allergic reactions resulting from participation in our Services.

1.5. When attending an Explore and Learn Service, we kindly request that any food you bring be nut-free. We also encourage you to refrain from consuming food or beverages in the activity areas. While we appreciate your cooperation, please understand that we do not police these guidelines, but they help us maintain a safe and enjoyable environment for everyone.

1.6. Parents or guardians of children attending an Explore and Learn Service must ensure that nappies or underwear remain on at all times. Please inform a member of staff if your child has had a toilet accident so the station/products can be taken away to be cleaned, sterilised and replaced.

1.7. Participants in our Services engage in activities involving sensory play, which can be messy and occasionally include substances like slime. While we prioritise safety, there is an inherent risk of mess and, in rare cases, minor accidents. By booking a Service, you acknowledge and accept this inherent risk. Explore and Learn is not liable for any injuries or damages that may occur during the Service, except in cases of gross negligence or wilful misconduct on our part.
Some stations may contain 'wet' materials which could cause the floor around them to become slippery. Please be sure to WALK carefully between stations.

2. MESSY PLAY BOOKINGS

2.1. To ensure the activity area does not become overcrowded - each ticket is valid for entry to your Explore and Learn event for ONE child and ONE parent/carer. An additional ticket must be purchased for any additional adults wishing to attend.

2.2. Explore and Learn takes no responsibility should you fail to attend a casual session booked (including illness). No refunds or credits will apply in this instance.

2.3. Please check-in with a staff member upon arrival at your session. Please show your ticket confirmation upon entry to your session. Screenshots will not be accepted.

2.4. If an Explore and Learn facilitator observes that a child is unwell or displays symptoms of sickness, either before or during the service, Explore and Learn reserves the right to disallow the child's attendance in the interest of health and safety for all participants. Please note that no refunds or credits will be issued in such cases.

2.5. Payment is required in full at the time of booking for a Explore and Learn event or class. The booking price is inclusive of any fees, charges and GST.

2.6. Due to hire charges, preparation and material costs, your ticket is non-refundable or non-changeable for any missed classes or events. You MAY transfer your ticket to someone else. Please email info@exploreandlearn.com.au with any name changes should you pass on your ticket. Term Enrolments have the option to complete a make up session during the week subject to availability.

3. REFUNDS

3.1. To the extent permitted by law, any deposit paid to Explore and Learn is non-refundable (regardless of when the Booking is cancelled).

3.2. Where Explore and Learn cancels a booking due to no fault of the customer, Explore and Learn will offer a refund to the Customer of all Fees paid.

3.3 Once a student is enrolled for a (10 week package) given term, there are strictly no cancellations allowed during the term. Fees for that (10 weeks) term are non-refundable and cannot be held in credit.

3.4. Explore and Learn may, on occasion, approve a request for a refund submitted by a Customer. Where this occurs and a refund is subsequently approved by Explore and Learn, the Customer will have their Fee refunded, less the deposit and any transaction fees.

Messy Play Term Dates for 2024

Students are required to attend the full term independent of the school system they attend.
Term 1: Tues 30th Jan – Tues 9th April
Term 2: Tues 30th April – Tues 2nd July
Term 3: Tues 23rd July – Tues 24th Sept
Term 4: Tues 15th Oct – Tues 17th Dec

4. COMMUNICATION

4.1. Parents and/or caregivers give consent to receive any form of communication from Explore and Learn related to important updates, events, and promotions from time to time to the contact details provided upon submission of the enrolment form.

4.2. The regulations, policies and procedures set out in this document are satisfactorily observed in all respects.

5. PHOTOS & PUBLISHING

5.1. Your Explore and Learn facilitator may take photos and videos during the session. These may be used on our website, social media pages and for advertising or promotional purposes.

5.2. If you do not wish to have photos taken of yourself or your child please state this on your booking form and let your event leader know when you check-in. We will however always ask verbally for permission before taking a photo during the session.

6. DISCLAIMER

6.1. While Explore and Learn commits to cleaning the area once the Service has concluded, please be advised that we are not responsible for cleaning stains on carpeted areas. To ensure the best experience, we recommend hosting parties in an area where food and various stains can be easily cleaned. Our cleaning procedure extends to the specific area where the activities are conducted and does not encompass the entire venue or household.

6.2. The nature of our business is MESSY play- We encourage you to dress your child and yourself in clothes that you do not mind getting messy, stained or dirty. Explore and Learn accepts no responsibility for clothes or belongings that are stained, marked, damaged or left behind.
6.3. Our programs and activities are designed to be age-appropriate and safe. However, individual children may react differently to the sensory materials and activities. Parents or guardians should use their judgement to determine whether a particular activity is suitable for their child.

6.4. Any testimonials or reviews on our website or promotional materials represent the experiences of previous customers. Individual results may vary, and Explore and Learn does not guarantee the same experiences or results for all participants.

6.5. Explore and Learn under no circumstance takes any responsibility for loss or damages to personal possessions during a messy play session.

7. INDEMNITY

7.1. The parent(s) and/or caregivers of the Student agree to release, indemnify and defend Explore and Learn, with respect to all claims, liabilities, losses, suits or expenses (including costs and reasonable legal fees), made or brought by anyone, including a co-participant, third party, the Student, parents or caregivers of the Student, or any member of the Student’s family, arising out of any injury, damage, or other loss in any way connected with the Student’s enrolment or participation in Explore and Learn activities or use of Explore and Learn services, equipment, tuition, facilities or materials, however caused.

8. CONFLICT OF INTEREST

8.1. All persons attending Explore and Learn Pty Ltd sessions are not permitted to establish any similar messy play groups within a 30-mile radius of the venue that they have attended. All activities (i.e. materials, layout, themes and supporting reference materials) are the ideas and Intellectual property of Explore and Learn Ltd and must not be used and / or copied without prior, written permission from a Explore and Learn Ltd Director.

MESSY PLAY PRIVATE BOOKINGS

2. PAYMENT & CANCELLATIONS

2.1. A $100 non-refundable deposit is required to secure your private booking. The remaining balance is to be paid via bank transfer a minimum of 14 days before the date of the event.

2.2. Booking price includes any fees and charges..

2.3. Due to planning, preparation and material costs, final payment is non-refundable or non-changeable for any cancellations within the 7 days leading up to the booking.

2.4. Explore and Learn reserves the right to cancel a private booking due to unforeseen circumstances. In the unlikely event this happens; the booking contact will be contacted as soon as possible and a refund will be offered or a credit/gift voucher provided for use within the next 12 months.

3. OFF SITE PARTY CONSIDERATIONS:

3. 1. Please be aware if hiring a venue for your private party we will need access for a

minimum 3 hours. Approximately 1 hour to set up (dependant of package), 1 hour of

messy play and approximately 1 hour to clean up. Clean up includes designated area of messy play set up only.

3.2. Please be aware that if your venue is outdoors we do require shade to set up under

as the black trays used for the activities can get extremely hot in direct sun.

4. PHOTO CONSENT:

4.1. Photos and short videos may be taken during our sessions. These may be used on our website, social media pages and for advertising or promotional purposes. If you do not wish to have photos taken of yourself or your child please state this onyour booking form. We will however always ask for permission before taking a photo during the session.

4.2. Photos are NOT taken during any Early Learning Centre or School Incursions.

5. SOFT PLAY

5.1. You reserve the right to inspect the Service items when they are delivered and notify the Explore and Learn staff at the time of arrival & set up, should there be any issues or damage.

5.2. You agree that Explore and Learn and its employees shall not be liable for personal injury or damages arising from the hire of the item/s.

5.3. You agree that you are responsible for determining the suitability for the age and skill of participating children, and agree to supervise the use at all times.

5.4. Should any of the items be stolen, destroyed or damaged from any cause, you agree to pay on demand the replacement cost for the damaged equipment. If individual items are damaged or lost, the cost of part or whole product will be charged.

5.5. You agree not to bring food, cake, icing, face paint, lollies, drinks and/or shoes onto the soft play equipment. Failure to do so may result in your bond partially or fully claimed by Explore and Learn.
