Terms and Conditions - Tutoring and School Readiness

The following are the Conditions of your Explore and Learn Contract. This contract is between Explore and Learn and you as detailed in the Application Form (the “Client”). In order to receive the tuition services detailed in the Application Form you agree to abide by the following Conditions. When this contract references “we” or “us” it shall be read as reference to Explore and Learn.

ENROLMENT POLICY & PROCEDURE

1. It is compulsory for all K to 6 students enrolling in regular Math and/or English small group classes to take a free initial assessment prior to enrolment.

 

2. Parents and/or caregivers must complete the enrolment process by completing the digital enrolment form and editing and updating all the required fields when changes occur.

 

3. Conditions of enrolment:

 

Parents and/or caregivers agree that students are enrolled at Explore and Learn according to the following terms and conditions:

 

3.1  For regular tuition, the minimum enrolment period is one (1) complete term as per the Explore and Learn term dates.

3.2.  Once the offer of enrolment is made, it is required to accept the offer within 3 business days and pay a non-refundable 20% deposit to confirm the allocation.

3.3.  A place reserved for a student may be offered to another student if the enrolment procedure and fee payments are not observed.

3.4.  Unsatisfactory discipline and/or attendance of students may result in termination of enrolment and Explore and Learn has the full right to do so. No refunds will be provided for such terminations.

NSW Term Dates for 2024

Students are required to attend the full term independent of the school system they attend.
Term 1: Thurs 1st Feb – Fri 12th April

Term 2: Mon 29th April – Fri 28th June
Term 3: Mon 22rd July – Fri 27th Sept
Term 4: Mon 14th Oct – Wed 18th Dec

 

B. ENROLMENT CANCELLATION POLICY

3.1.1.  Once a student is enrolled for a 5 week package in a given term, there are strictly no cancellations allowed during that 5 week period. Fees for that term are non-refundable and cannot be held in credit.

3.1.2.  Enrolment will automatically roll over from one term to the next, unless the cancellation of enrolment for the new term is notified to us by completing the Request to Cancel Form at least 4 weeks prior to the first day of the new term. Please refer to the table below for the cancellation notification deadline set out for each term. Please refer to Appendix 1 for notice period of cancellation for individual tuition.

3.1.3.  Failure to provide notification by the deadlines indicated in the table above will incur a $55 class cancellation fee.

 

4. RESCHEDULING A LESSON

4.1. We understand that external factors and sickness arise requiring lessons to be rescheduled or made up. We provide the option of rescheduling or making up one lesson at an agreed time once per term. We require 24 hours notice to reschedule or make up a lesson. This is to provide tutors with a fair amount of time to adjust their schedule.

4.2. You will not be eligible for another makeup session if you cannot attend the confirmed makeup session that is scheduled. If you have booked a makeup session and miss this session, your makeup session will be forfeited. Please note makeup sessions cannot be carried over to the next term.

4.3. If we cannot provide a session, we will contact you to reschedule the session at a mutually agreed time. If the session cannot be rescheduled and needs to be cancelled, you will be provided a credit to reschedule with another tutor.

4.4. Please keep in mind that repeat cancellations from parents and/or tutors may see accounts placed under review and possibly terminated.

5. PAYMENT POLICY

5.1. Payment requests are sent prior to the commencement of each 5 week plan and outline the plan’s fees based on the lessons booked with the tutor. The full amount is due to be fully paid a week in advance.

b. A minimum of 5 weeks fees must be paid prior to the commencement of each tutoring term to secure your place with a tutor.

 

6. ETHICAL RESPONSIBILITIES

Explore and Learn Tutors:

6.1. Will use their resources for the best educational outcomes of their students.

6.2. Aim to use our teaching and learning practices to enhance students self concept, confidence to learn and to assist student to understand their learning style.

c. Utilise their skills, to the best of their ability, to teach students with the objective to improve in the subjects in which they receive tuition, however do not accept responsibility for final exam results or assignment work grades.

7. DROP OFF & PICK UPS

7.1. Parents are required to drop their child(ren) off at most 10 minutes before the class starts and pick up immediately after the class ends. Any drop offs earlier or pick up later than the specified time frame is not acceptable. We do not provide supervision outside of class attendance and therefore do not take responsibility for any consequences due to early drop-offs or late pick-ups.

7.2. Parents are required to pick up their child(ren) as soon as their class sessions are completed. If not then a late pick-up fee of $25 for every 10 minutes or part thereof will be invoiced within 7 days and payable by the due date.

7.3. We strongly advise parents and/or caregivers to walk your child into the centre during drop offs (especially younger children) and walk into the centre to pick up your child for safety and security reasons.

 

8. COMMUNICATION

8.1. Parents and/or caregivers give consent to receive any form of communication from Explore and Learn related to important updates, events, and promotions from time to time to the contact details provided upon submission of the enrolment form.

8.2. The regulations, policies and procedures set out in this document are satisfactorily observed in all respects.

 
9. EXPLORE AND LEARN STUDIO EXPECTATIONS

9.1. Should a student cause any damage to the centre’s property, parents or guardians are to be held responsible for compensation including full costs of repair.

9.2. Students, parents and guardians must enter and exit the centre premises accordingly and sensibly to avoid disturbances to others.

9.3. Students, parents and guardians making disruptions such as loud ringing, calls or audio from mobiles, whistling or loud conversation may be asked to leave the centre.

9.4. All food and drink consumed must not have nuts to prevent reactions to any allergies that may be present.

9.5. Parents and guardians are expected to wait for their child/children in the area provided, and not to enter the classroom while there are students at work.

10. LIABILITY

10.1. Parents and caregivers agree that, in the event of illness or injury to the student necessitating urgent hospital and/or medical treatment, including injections, blood transfusions, surgery and the like, and if the parent or guardian is not readily available to authorise such treatment, Explore and Learn will give the necessary authority for such treatment without the organisation or any persons associated with Explore and Learn incurring any legal liability to the parent or guardian or student in so doing. Parents agree to bear all costs associated with the treatment of such emergencies, ambulance services and other associated costs related to the medical treatment.

10.2. The parent or guardian acknowledges and agrees that all costs incurred as a result of any damage, injury, loss, expense or liability that may be caused to public and/ or private property by the student will be completely paid to Explore and Learn.

10.3. The parent or guardian acknowledges and agrees that Explore and Learn is not liable for any damage, accidents, injury, loss, expense or liability that may occur to any person including students attending the premises.

11. INDEMNITY

11.1. The parent(s) and/or caregivers of the Student agree to release, indemnify and defend Explore and Learn, with respect to all claims, liabilities, losses, suits or expenses (including costs and reasonable legal fees), made or brought by anyone, including a co-participant, third party, the Student, parents or caregivers of the Student, or any member of the Student’s family, arising out of any injury, damage, or other loss in any way connected with the Student’s enrolment or participation in Explore and Learn activities or use of Explore and Learn services, equipment, tuition, facilities or materials, however caused.
